The following Terms and Conditions govern the dry hire of machinery, equipment, and trailers from Marsden Hire (ABN: 73 636 961 441). By booking or taking possession of our equipment, the Hirer agrees to be bound by these terms.

Disclaimer: These terms serve as a general website guide. A comprehensive hire agreement will be provided and must be signed prior to the handover of any machinery.

1. Dry Hire Agreement

All equipment is supplied on a “Dry Hire” basis (without an operator). The Hirer is solely responsible for ensuring that anyone operating the machinery is competent, adequately trained, and holds all necessary and legally required licenses or tickets (e.g., VOC) for the specific equipment and site.

2. Equipment Condition & Usage

Marsden Hire agrees to supply the equipment in a safe, clean, and fully operational condition. The Hirer must inspect the equipment upon delivery/pick-up. The machinery must only be used for its intended purpose and operated in a safe manner in accordance with the manufacturer’s guidelines and standard civil construction practices.

3. Delivery and Pick-Up

Transport costs for delivery to and from the job site will be quoted prior to hire. If the Hirer chooses to pick up the equipment from our Riverstone depot, they must possess a legally compliant towing vehicle and assume all responsibility for safe loading, load restraint, and transport.

4. Fuel and Cleaning

Equipment is supplied with a full tank of the correct fuel (diesel or unleaded) and must be returned full. Failure to do so will result in refueling charges at a premium rate. The machinery must be returned reasonably clean. Excessive mud, concrete, or debris will incur a cleaning fee.

5. Damage, Loss, and Insurance

The Hirer is liable for the safekeeping of the equipment during the hire period. While Marsden Hire maintains appropriate insurances, the Hirer is financially responsible for any loss, theft, or damage caused by negligence, misuse, failure to maintain fluid levels, or breaches of this agreement. Any damage must be reported to Marsden Hire immediately.

6. Payment Terms

Hire charges are calculated on a daily, weekly, or monthly basis as agreed. Payment, including any required security deposits, must be made as per the terms outlined in your formal hire agreement. Late returns will incur additional daily hire charges.

7. Liability

To the maximum extent permitted by law, Marsden Hire is not liable for any indirect, incidental, or consequential damages, including loss of profits or project delays, resulting from the breakdown or failure of the hired equipment.
